Terms of Sale: SiteGuard FORMS
SG-LEGAL-02, version 0.4, 19 October 2026
1. About these terms
These terms apply when you buy from siteguardforms.com.au or the SiteGuard FORMS app. "We", "us" and "SiteGuard" mean SiteGuard Systems (ABN 36 765 797 871, a business name of Daniel Silver), Melbourne, Victoria. "You" means the person or business placing the order. By placing an order you agree to these terms, the Document Use Disclaimer and our Privacy Policy.
2. Products
- We sell digital document templates individually and in packages, by one-off purchase or by subscription. Each product page lists the documents included.
- Documents are templates, not site-specific advice. The Document Use Disclaimer explains what that means for you.
- Custom documents and consulting work are supplied under a separate written quote.
3. Prices, GST and payment
- Prices are in Australian dollars and exclude GST. GST is calculated and added at checkout where it applies, and shown on your tax invoice.
- Payment is taken by card through our payment provider, Stripe, when you place the order (one-off) or at the start of each billing period (subscription). We don't receive or store your full card details.
- We may change prices at any time. A change doesn't affect an order already placed. For subscriptions, see clause 5.4.
4. Delivery and your licence
- Delivery. After payment, your documents are generated with the details you give us and emailed to the address you nominate, usually within minutes. Some orders are checked by our team before they are sent, usually within 1 business day. Every set comes with the Document Use Disclaimer. If we can't deliver an item, we'll tell you and refund that item.
- Licence. On delivery we grant you a non-exclusive, non-transferable licence to use, copy, adapt and complete the documents for your own business and your own projects, without limit on the number of projects, and to give completed copies to your workers, subcontractors, principal contractors, clients and regulators for those projects.
- What you may not do. Unless you hold a Consultant subscription, you may not sell, sublicense, publish, share or distribute the templates (completed or blank) to anyone outside your business for their own use, or present them as your own product.
- Consultant subscriptions. A Consultant subscriber may also use and adapt the documents while delivering services to its own clients, under the scope of its tier. It may not resell the templates as a standalone product, or publish them.
- Ownership. We, or our licensors, keep ownership of the copyright in the templates. You own the information you add to them.
5. Subscriptions
- Terms. Subscriptions are billed annually, or monthly at a higher annualised rate. Each subscription covers the package shown at purchase.
- What's included. For as long as your subscription is active, you get the current revision of every document in your package, and the revised documents we issue after each 6-monthly legislative review. Use is unlimited, with no limit on projects.
- Renewal. Your subscription renews automatically at the end of each period, unless you cancel before the renewal date. For annual subscriptions, we'll email you a reminder at least 14 days before renewal.
- Price changes. We'll give you at least 30 days' notice by email before a price change applies to your subscription. If you don't accept it, you can cancel before it takes effect.
- Cancelling. You can cancel at any time through your account or by emailing us. Cancellation takes effect at the end of the current billing period. Refunds are covered by the Refunds and Cancellations Policy.
- After a subscription ends. You may keep using documents delivered while you were subscribed, under the licence in clause 4. You won't receive further revisions.
6. Your responsibilities
You must give accurate order and account details, and keep your account login secure. You are responsible for how the documents are used. The Document Use Disclaimer explains these duties.
7. Consumer guarantees and liability
- Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right that cannot lawfully be excluded.
- Subject to clause 7.1, and to the extent permitted by law, our liability for any failure to comply with a guarantee, or for any other claim connected with a product, is limited, at our option, to supplying the product again or refunding the price paid for it.
- To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from your use of a document without the review and adaptation that the Document Use Disclaimer describes.
8. Changes to these terms
We may update these terms. The version published when you place an order applies to that order. For subscriptions, changes apply from your next billing period; we'll email you about any material change.
9. Governing law
These terms are governed by the laws of Victoria, Australia. Each party submits to the courts of Victoria.
